Preface:

1 - Subject of the Contract

• The subject of the contract is the use of the services provided on the website iqcheck24.de by customers who are registered for this service.
• iqcheck24.de provides its customers with access to its services in exchange for a registration fee and a monthly subscription fee (see Article 2 below). For this, the customer must fill out a form that follows specific criteria.
  
• The customer’s answers to the questions used to create and complete their profile are stored in the database. These data will not be rented or sold to third parties. Data is only passed on for contract fulfillment or to technical service providers (e.g., payment providers, hosting).

2 - Conclusion of the Contract

• Using the service requires the customer to register beforehand. Registration and the IQ test itself are free of charge. The detailed results and the certificate are subject to a fee of €0.99 (incl. VAT). After paying this amount, the customer gains access to their personal customer account. There they can use additional features at any time.
  The paid subscription costs €9.99 (incl. VAT) per month with a minimum term of 3 months. After these three months, the subscription automatically renews for an additional month unless it is canceled.
• The contract for paid services is concluded when the customer clicks the “Order with payment obligation” button. Before placing the order, the essential contractual elements (price, duration, cancellation conditions) are clearly presented.

3 - Terms of Use

• The subscription purchased by the customer is personal, non-transferable, and may not be shared with third parties.
• The customer must promptly inform iqcheck24.de of any changes to their personal data necessary for providing the service, especially payment data.
• The customer agrees to comply with confidentiality obligations. Unauthorized sharing or publishing of data is prohibited.
• The customer agrees to use the services solely for private purposes. Commercial or abusive use is prohibited.
• The customer may not use the service to distribute unlawful, offensive, or harmful content.
• The customer must not undertake anything that could disrupt or endanger the functionality of the service (e.g., spam, viruses, malware).
• iqcheck24.de reserves the right to review content and block or delete access in the event of violations.
• Communications to iqcheck24.de are made via email to kontakt@iqcheck24.de or through the website.
• The customer accepts that content they download or share may be visible to other users, provided this feature is enabled.
• Automated messages in the name of the customer are only sent with the customer’s explicit consent and can be deactivated at any time.

4 - Termination and Refunds

• The user confirms understanding that digital services are considered provided from the moment they are made available (access to test results/certificate). In accordance with Directive 2011/83/EU, the right of withdrawal expires once the user explicitly agrees to the immediate execution.
• The user may cancel their subscription at any time after the minimum contract term without additional costs. Cancellation is possible:
• via the cancellation button in the customer area, or
• by email to kontakt@iqcheck24.de (subject: “Termination of Agreement,” including first and last name and email address).
• The customer may not use the service to distribute unlawful, offensive, or harmful content.
• The customer may not undertake anything that disrupts or endangers the functionality of the service (e.g., spam, viruses, malware).
• Upon cancellation, the user will not receive a refund for billing periods that have already started, except where payment was made in advance and the cancellation is received before the next billing period begins.
• Refund requests must be sent via email to kontakt@iqcheck24.de (subject: “Refund Request,” including first and last name, email address, and bank details).
• All requests are processed within 14 days.

5 - Liability

• iqcheck24.de is fully liable for intent and gross negligence.
• In cases of slight negligence, iqcheck24.de is only liable for essential contractual obligations and limited to the typical foreseeable damage.
• Liability for indirect damage, lost profits, or consequential damages is excluded.

6 - Final Provisions

• The law of the Republic of Bulgaria applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection laws of the customer’s country of residence take precedence.
• If any provision of these legal notices is invalid, the validity of the remaining provisions remains unaffected.
